Judge Hamza assigns DSS to arraign Emefiele in one week

Justice Hamza Muazu of the High Court of the Federal Capital Territory, Abuja, has given the Department of State Services (DSS) a one-week ultimatum to either charge or release Godwin Emefiele, the suspended Governor of the Central Bank of Nigeria (CBN).

The ultimatum was issued on Thursday during the ruling on a fundamental human rights suit brought by Emefiele against the DSS and others.

Justice Muazu acknowledged that the DSS has the authority to carry out its constitutional duties of arrest, detention, and crime prevention.

However, he emphasized that these duties must be executed within the confines of the law.

The judge stated that the arrest power of the DSS is subject to certain conditions regarding the duration and treatment of detained individuals.

The suit, filed on behalf of Emefiele by Senior Advocate of Nigeria Joseph Daudu, sought the enforcement of the suspended CBN Governor’s fundamental human rights to freedom of movement and dignity of human life.

Emefiele argued that his arrest and detention since June 10, without a valid court order, should be declared void and set aside.

He also requested compensation of N5 million as exemplary damages for his alleged unlawful detention.

The ruling by Justice Muazu reflects the importance of upholding the rule of law and ensuring that individuals’ fundamental human rights are respected.

The judge’s ultimatum to the DSS indicates that Emefiele’s case must be dealt with promptly and in accordance with legal procedures.
