According to him, his data was leaked by an employee of Absa bank, thereby affecting his business operations negatively.

“As a result of the leakage, the plaintiff’s creditors and other suppliers descended upon him and interrupted the business operations,” Kamwibua said.

The CEO accused the bank and its employee of infringing on his right to privacy by disclosing confidential information to third parties.

Speaking further, he revealed that the failure to maintain the secrecy of his bank accounts by sharing his financial statements with strangers amounts to a breach of its common law of fiduciary duty.

Kamwibua also said that efforts to save his transport business by requesting the bank to restructure its loan obligations were ignored and resulted in financial sabotage.
