UK immigration reveals new rules
The United Kingdom government has published about 205 pages of changes to some of the immigration rules which will be phased over the next few months starting from 6th April 2022.
As against the previous 10year duration, children who have lived in the UK for seven years can get immigration permission with settlement either immediately or after 5 years.
Last May, the Court ruled that the government policy of denying benefits to migrants was in breach of statutory duty to promote the welfare of children.
This is being made changes to by the home office that judgement.The language is now been softened to remove ‘normally’ add an exception for ‘imminent destitution’ and also make it just ‘reasons’ that do not need to be particularly compelling. This will take effect from 20 June 2022.
The promises changes to temporary business visa including a new ‘secondment’ visa category.
Changes to the no recourse to public funds regime in response to a High court ruling is now being softened
This involves a new paragraph GEN 1.11A which stipulates that immigration permission as a partner, child or parent ‘normally’ now comes with no recourse to public funds. This exceptions are if the applicant is ‘destitute’ or there are ‘particularly compelling reasons’ relating to child welfare.
Concessions of EU settlement scheme family permits are been written into the rules proper.
