Supreme court rules against EFCC, upturns SAN’s conviction

The Economic and Financial Crimes Commission(EFCC) has had a conviction against an arraigned Senior Advocate of Nigeria, Joseph Nwobike, upturned by the Supreme Court.

The EFCC had arraigned him Nwobike before a Lagos State High Court on an 18 counts charge which bordered on attempts to pervert the course of justice, offering gratification to a public officer and giving false information to an EFCC official.

Nwobike was convicted in 2018 on 12 of the counts by Justice Raliatu Adebiyi and was subsequently stripped of his SAN title.

Nwobike had showed dissatisfaction with his conviction by filing an appeal on the matter but his conviction was upheld by the Court of Appeal.

However, a five-member panel of the Supreme Court led by a Justice Olukayode Ariwoola on Monday upturned the conviction ruling that the EFCC lacked the power to prosecute anyone for the offence of perversion of justice.
