Court rules on suit seeking nullification of Oyetola’s candidacy

The Supreme Court of Nigeria has dismissed an appeal by the Peoples Democratic Party (PDP) regarding the participation of former Governor Gboyega Oyetola and his deputy Benedict Alabi in the July 16, 2022 governorship election in Osun state

The appeal sought to restore the nullification of the two candidates’ participation, which was initially nullified by Justice Emeka Nwite of the Federal High Court in Abuja on September 30, 2022.

However, the Court of Appeal in Abuja overturned the judgment in December 2022, a decision that the PDP appealed to the Supreme Court.

In its ruling, the five-member panel of the Supreme Court, led by Justice Centus Nweze, stated that the PDP’s appeal was without merit and directed the party’s lawyer, Kehinde Ogunwumiju (SAN), to withdraw it.

The Supreme Court held that the PDP could not legally challenge the process that led to the emergence of Oyetola and Alabi as candidates of the All Progressives Congress (APC) in the election.

The court’s ruling brings the legal challenges surrounding the Osun governorship election to a close and affirms the validity of Oyetola and Alabi’s participation in the election.
